Joe Biden is Fit!
The Transcripts from the Special Counsel Investigations Virtually Prove It
The transcripts of Special Counsel Robert Hur’s interviews of Joe Biden revealed a highly sophisticated, witty, and cognitively-intact president who is more than capable of formulating long sentences and engaging in nuanced discussions on complex thoughts over multiple hours. Occasional, minor memory lapses in this broader context do not represent anything more than incidental, easily correctable, slips (which Hur did not attempt to do). Far from showing a “well-meaning, elderly man with poor memory,” Biden’s overall performance was of superior level, regardless of age. A mental health expert would rather question Hur’s mental capacity in his need to exaggerate this insignificant aspect, as he revealed in his report.
I always considered it odd that Hur refused to proceed to a trial because of what he thought the jury would say. This is not a factor a prosecutor usually considers: either you believe you have a legal case beyond a reasonable doubt, or not. I thought of the possibility that he himself wished to show deference and consideration for an older president by not putting him through a lengthy process, but his rudeness during the interview dispels this benefit of doubt.
Rather, it appears that Hur not only fabricated mental problems for Biden, he may have avoided a trial because he feared exposure of a total witch hunt: investigating Biden’s incidental finding of 80 classified documents gave the veneer of “equivalence” with investigating Donald Trump’s calculated theft of 300 classified documents and obstruction of justice, for the apparent purpose of selling them for maximal profit, no matter the endangerment of national security. Biden’s impeccable innocence—in intent if not in deed (you need both for conviction)—would have made the contrast with Trump too stark for the charade to hold.
Rep. Ted Lieu demonstrated this powerfully at the House Judiciary Committee hearing of March 12, 2024:
Hon. Ted Lieu: In your investigation, did you find that President Biden directed his lawyer to lie to the FBI?
Mr. Robert Hur: We identified no such evidence.
Hon. Lieu: Did you find that President Biden directed his lawyer to destroy classified documents?
Mr. Hur: No.
Hon. Lieu: Did you find that President Biden directed his personal assistant to move boxes of documents to hide them from the FBI?
Mr. Hur: No.
Hon. Lieu: Did you find that President Biden directed his personal assistant to delete security camera footage after the FBI asked for that footage?
Mr. Hur: No.
Hon. Lieu: Did you find that President Biden showed a classified map related to an ongoing military operation to a campaign aide who did not have clearance?
Mr. Hur: No.
Hon. Lieu: Did you find that President Biden engaged in a conspiracy to obstruct justice?
Mr. Hur:
Hon. Lieu: No. Did you find that President Biden engaged in a scheme to conceal?
Mr. Hur: No.
Hon. Lieu: Each of the activities, I just laid out describe what Donald Trump did, in his willful mishandling of classified information and his criminal efforts to deceive the FBI. In contrast, President Biden handed over documents without delay and complied fully with investigators. Mr. Hur, in you report, you write that, “according to the indictment, Trump not only refused to return the documents for many months, but he also obstructed justice by enlisting others to destroy evidence and then to lie about it.” You also say that, if proven, these would be “serious, aggravating facts.” Do you still stand by your analysis?
Mr. Hur: I do.
The excessive and gratuitous embellishment on a finding of no guilt, going as far as to fabricate mental problems in Biden in order to cast maximal doubt on the verdict of innocence, makes Hur’s motives suspect. Furthermore, the Democratic Attorney General Merrick Garland’s failure to suppress indecent manipulations and, indeed, lies is as destructive as the former Republican Attorney General Bill Barr’s aggressive whitewashing of Donald Trump’s felony crimes and election through massive benefit from the Russians.
Donald Trump appointed Hur, which confirms my earlier caution that an unfit president is likely to appoint unfit candidates for positions, no matter who is doing the selection (being unfit, Trump would be naturally drawn to unfit candidates, but even if not, others could use this “opportunity” to advance unfit persons—as we have seen with the packing of the Supreme Court). This is a part of the “Trump Contagion” I have been warning against, and how weak states or “Banana Republics” come to form, with “lunatics” in charge of the asylum and criminals running the show.
There is another reason Hur may have been terrified of a detailed investigation: it was likely to reveal, like Biden’s seamless innocence, his seamless mental fitness that came out in the interview.
Biden has a solution to all this, which I and my colleagues have been recommending since 2020. He is clearly mentally fit, as confirmed repeatedly in his real-life performance as well as his recent interview under investigation, while Trump has been proven unfit by a panel of independent experts. Biden could meet Trump’s own challenge, repeated as recently as on February 29, 2024, to: “take a Cognitive Test…. All Presidents, or people wanting to become President, should mandatorily take this test!” They could both take a mental fitness test, and set a new standard for all presidents to come.
Donald Trump is referring above, of course, to a ten-minute screen that dementia patients and hospitalized persons with schizophrenia routinely “ace”, or score perfectly on, which is meaningless for the job of president. Trump has been bragging about this test for over six years, because the unethical, illegal narcotics-dealing, drunk-on-the-job “doctor” Ronny Jackson lied that it was a “fitness test”—which he was neither qualified nor trained to perform. Jackson did this to ingratiate himself into a Congressional seat, but left the mess of an unfit former president bragging about passing a non-fitness test—which is exactly what unfit persons do. We can use this as an opportunity, however, since Trump’s narcissistic hubris may well bring him to taking a real fitness test. It is also the responsible thing for both candidates to do, when the public, who is a president’s employer, has been clamoring that mental fitness is an issue for them. Does it make sense that any employer in the United States can demand a fitness test of any employee, and have the employee not return until it is complete, but the most sovereign employer, the People, cannot of a position for which fitness is existentially important to them?
